General TENERAL-Guideline
to the common NDA / Non-Disclosure Agreements

We do not share customer data with third parties.
We provide our customers with the highest level of technical information and expect them not to provide us with information that would jeopardize their own situation or expose us to unjustified accusations.
We generally do not sign non-disclosure agreements, as these often contain obligations that are difficult to monitor in a production environment.
It is impossible for both parties to fairly monitor the restrictions of a confidentiality agreement.
In today’s intensive information flow, it is impossible to ensure the full terms of a non-disclosure agreement. Signing of this commitment is basically the reliance on the impossibility of proof.
Today, the source, provenance, and origin of information cannot be accurately documented. Traceability is quite impossible.
Both the recipient and the provider of information can easily be accused of providing false evidence, which can lead to an unfair burden of defense and even punishment. Contracts inevitably contain very broad, general terms whose clarity is physically impossible to ensure, and restrictions whose responsibilities cannot be clearly identified. The security of these conditions cannot be guaranteed in a corporate or production environment.
Nevertheless, in today’s business environment, such contracts are frequently signed. Signatories, consciously or unconsciously, invariably rely on the mercy of the person requesting the contract. It is physically impossible otherwise.
The possibility of a contract being subject to litigation or enforcement only arises in the event of a dispute. Assuming vaguely defined responsibility has very critical consequences in such a case.
Another important reason is that in all our interactions, we are often the party sharing and exporting a significant amount of technical information. It would be unfair to assume legal liability for the relatively limited information, which the customer party provides us solely to ensure the highest quality of their own work.
Furthermore, there is no guarantee that the technical information the customer wishes to carefully protect is not already in our possession; in fact, the opposite is often proven.
We ask for your understanding and wish for a trusting cooperation.
